General terms and conditions of sale 

Art. 1.           Scope of application and amendment of the general terms and conditions of sale  

These general terms and conditions of sale (GTC) apply to any order placed on the website  www.legitech.lu (le Site). 

Legitech reserves the right to adapt or modify these GTC at any time. In case of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.  

In the present document, the periods expressed in days are understood to be working days unless expressly stated otherwise.  

Art. 2.           Availability of products  

Legitech product offers are valid while stocks last.  

As soon as the order is validated by the buyer, Legitech checks the availability of the product(s) ordered. In the event of unavailability, Legitech undertakes, within 15 days from the validation of the order, as defined in article 3, to contact the purchaser to ask for a bank account number to proceed with reimbursement by bank transfer.  

In the event of a stock shortage on one of the products in the buyer's order, Legitech will dispatch the rest of the order, without prejudice to the procedure described in the previous paragraphs.  

Art. 3.           Validation of orders and electronic signature  

Any validated order will be processed within the time limits and according to the methods provided for in particular in articles 2 and 6.  

  • By date of validation of the order we mean: 

  • the date of the order in the case of online payment by credit card.

  • the date of receipt of the transfer in the case of payment by bank transfer.

Any order form signed by the buyer by "clicking" on the "Order" button constitutes an irrevocable and full acceptance of these GCS, which can only be challenged within the limits provided by them.  

The said "click" constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.  

Art. 4.           Prices  

Legitech reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of the order. To these prices must be added the delivery costs as defined in point 6.5.  

If the buyer wishes a delivery abroad, any local taxes are not included in the sales price and remain at the buyer's expense.  

 

Art. 5.           Methods of payment and security  

5.1 - Terms of Payment  

The buyer may pay by credit card.  

Payment is made on the secure bank servers of Legitech's partners (your choice) Paypal or Stripe.  

This implies that no banking information concerning the buyer transits via the Legitech site. Payment by credit card is therefore perfectly secure; the buyer's order will thus be recorded and validated as soon as the payment is accepted by the bank.  

The buyer can also pay by bank transfer. In this case, he will be asked to pay the invoice in advance before any shipment.  

The buyer guarantees that he is fully entitled to use the payment card or his account for the payment of his order and that these means of payment give access to sufficient funds to cover all the costs related to the order placed with Legitech.  

5.2 - Retention of title clause  

The products remain the property of Legitech until Legitech has received full payment for the order. However, as from receipt of the order, the risks on the goods delivered are transferred to the buyer.  

5.3 - Default of Payment  

Legitech reserves the right to refuse to make a delivery or to honour an order from a buyer who has not fully paid for a previous order or with whom a payment dispute is in progress.  

 5.4 - Anti-fraud controls  

Legitech controls all orders that have been validated on the Site. These controls aim to protect Legitech from abusive practices operated by fraudsters.  

For an order with a delivery address different from the billing address, Legitech may need to contact the buyer or the recipient of the delivery.  

As part of these procedures, Legitech may be required to ask the buyer for all the documents necessary to unblock the order: proof of address and debit in his name, but also proof of address in the name of the person indicated for the delivery address, etc.  

These requests are made by email. In the event of no response or an incomplete response, Legitech reserves the right to cancel the order.  

5.5 - Use of vouchers  

Vouchers can only be used for the purchase of books published by Legitech.  

Promotional vouchers and vouchers credited to the customer account as a commercial gesture cannot be converted into cash and give rise to a refund transfer. They are only applicable to a future order.  

Art. 6.           Deliveries  

6.1 - Terms and conditions  

Legitech delivers the works it publishes in all countries. Should a country present any problem (e.g. theft of postal parcels), Legitech reserves the right to contact the buyer and discuss the solution to the problem.  

The products are delivered to the delivery address indicated by the buyer during the ordering process.  

The buyer shall check the conformity of the goods delivered at the time of delivery. The buyer must also report any anomalies by e-mail to:  [email protected]and confirm his reservations no later than 48 working hours following receipt of the item(s).  

If the products need to be returned to Legitech, they must be the subject of a return request to Legitech's Customer Service Department according to the methods described in articles 9 and 10.  

6.2 - Delivery times  

The times indicated are average times and correspond to the processing, preparation and dispatch times of the order (ex-stock). They run from the validation of the order as defined in article 3.  

All items in stock are shipped within 24 to 48 hours.  

6.3 - Delivery times  

The product ordered is sent to the address shown on the order form. An e-mail confirming the dispatch of the order is automatically sent to the buyer.  

For a national shipment, it takes one or two days. For an international shipment, the delay can vary from 2 to 6 days.  

We invite you to inform us of any longer delays or delays in delivery.  

6.4 - Reception fault  

Any complaint in the event of non-receipt of the books ordered must be made by e-mail to:  [email protected] on pain of forfeiture, within one month from the date of dispatch of the parcel by us.  

6.5 - Delivery costs  

For all book shipments to Luxembourg and given the many lost parcels recorded in the past, Legitech offers a registered parcel, which is more expensive, but which ensures that the order is delivered correctly.  

Deliveries in Luxembourg: Free of charge (except for special works specified at the time of order). 

Deliveries in Europe : 5 € , outside Switzerland (10 € ) 

Art. 7.           Responsibilities  

Legitech shall not be held liable for the non-performance of the concluded contract, due to the occurrence of an event of force majeure and in particular in the event of total or partial strike of the postal services, carriers, and disasters caused by floods or fires.  

With respect to products purchased for professional needs, Legitech shall not be liable for any indirect damages, business interruption, loss of profit, damages or expenses, which may arise as a result hereof.  

The choice and purchase of a product or service is the sole responsibility of the buyer. The total or partial impossibility to use the products cannot give rise to any compensation, reimbursement or questioning of Legitech's responsibility, except in the case of a proven latent defect, non-conformity, defect or exercise of the right of retraction envisaged under article 9.  

Art. 8.           Treatment of parcels not delivered by the service provider  

These are packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage.  

8.1 - Returns under the NPAI motif  

General  

These are the parcels returned by the service provider in charge of the delivery under the mention: Does not live at the indicated address.  

Processing a NPAI return  

If the error in the address is attributable to Legitech, after receipt and acceptance of the package by Legitech, depending on the nature of the product, the available stocks and according to the buyer's wish expressed during a telephone contact or by e-mail, Legitech will offer to reship to the buyer the product initially ordered at Legitech's expense.  

However, if the error in the address is attributable to the buyer (at the time of the order), the forwarding costs will be borne by the buyer.  

Otherwise, a voucher will be credited to the buyer's account within 48 hours of receipt of the package by Legitech. If the buyer chooses to be reimbursed, a transfer of the amount of the product will be sent to him/her within 15 days following acceptance of the return.  

8.2 - Returns under the reason "refused".  

It is a package refused by the buyer because it shows obvious traces of opening and/or shocks.  

If the package is damaged, torn or opened, the buyer must refuse the package and contact Legitech's services in order to inform them. After Legitech has received and accepted the package, depending on the nature of the product, the available stocks and according to the buyer's wishes, Legitech will propose to the buyer to reship the product initially ordered at his expense.  

Art. 9.           Right of withdrawal  

9.1 - Deadline  

In accordance with article L.222-9 of the Consumer Code, the buyer has a period of 14 calendar days from the date of receipt of the order.  

The buyer therefore has 14 days to inform Legitech that he wishes to withdraw.  

Withdrawal must be made in writing (e-mail, fax, mail) to the customer service department who will assign a return agreement number to the buyer.  

The buyer may also use the model withdrawal form set out in Article R.222-2 of the Grand-Ducal Regulation of 2 April 2014 amending in particular the regulatory part of the Consumer Code. As soon as the buyer's decision to withdraw has been communicated, the buyer has 14 days to return the product to Legitech. After this period, the buyer's return will be refused.  

Legitech advises you to send the return by tracked delivery. Otherwise, if the parcel, sent by the buyer, and returning to Legitech services, does not reach him, the buyer will not be able to launch a survey with the postal services in order to ask them to locate it. It should be noted that any parcel not sent by Legitech is not under its responsibility, even if the product it contains remains its property (see article 5). As the sender, Legitech is therefore responsible, for example, for the proper packaging of the product and the selection of the appropriate postal service. Moreover, only the sender of the package is in a position to launch a survey with the postal services.  

9.2 - Exchange or refund  

The buyer may request an exchange or refund without penalty, with the exception of the return costs.  

After receipt and acceptance of the package by Legitech services, a voucher will be credited to the customer account within 48 hours of receipt of the package. It will correspond to the amount of the returned products.  

If the buyer has chosen to be reimbursed, a transfer of the amount of the returned products is sent within 14 days of Legitech being informed of the decision to withdraw.  

In order to process the request correctly, the buyer must remind Legitech of his order number and full contact details.  

9.3 - Returns  

A book must be returned to Legitech in its original packaging and in good condition, suitable for re-sale.  

WARNING: No retraction will be accepted if the returned product is unsuitable for re-sale. Consequently, the product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged and unmarked.  

Failing this, the product will be returned to the buyer at his expense.  

9.4 - Cost of return for retraction  

The costs of return in case of withdrawal remain at the expense of the buyer.  

Art. 10.         Right of return  

10.1 - Deadlines  

If the products need to be returned to Legitech, they must be the subject of a request for return to its Customer Service within 15 working days from the date of receipt of the order because of a defect or if the buyer had not received the correct reference.  

Any claim made after this period will not be accepted and the products will be deemed to conform to the order in quality and quantity.  

The return request must be made to Legitech customer service in writing (email, fax, mail).  

Upon receipt of the agreement, the buyer has 7 days to return the product to Legitech. After this period, his return will be refused.  

Legitech advises you to send the return by tracked delivery.  

Otherwise, if the parcel, sent by Legitech, and returned to its services, does not reach the buyer, the buyer will not be able to launch an enquiry with the postal services to ask them to locate it. It should be noted that any package not sent by Legitech is not under its responsibility, even if the product it contains remains its property (article 5). The sender is therefore responsible, for example, for the proper packaging of the product and the selection of the appropriate postal service. Furthermore, only the sender of the package is in a position to launch an enquiry with the postal services.  

10.2 - Returns  

If the buyer has not received the correct reference, the return of the product can only be accepted for products in their original state (packaging in perfect condition).  

At the time of delivery, the buyer must check the condition of the items ordered. If they have been damaged, the buyer may either refuse the package (mention on the packing slip: package refused because damaged), or inform Legitech by email at: [email protected] under 48 hours and resend the package according to the terms set out in the previous paragraph.  

Please note: Upon receipt, Legitech services will check the conformity of the returned product and the reason for return. If the returned product is not in conformity, it will be refused by Legitech services and will be sent back to the buyer at his expense. If the buyer returns the product for the wrong reason, the product may be refused and will be sent back to the buyer at his expense. The reason for the return may in particular be re-qualified. The buyer will then be informed by email and the return will be processed according to the new reason.  

In order to process the buyer's request correctly, the buyer must recall his order number and full contact details.  

10.3 - Exchange or refund  

After Legitech has received and accepted the package, depending on the nature of the product, available stocks and according to the buyer's wishes, Legitech will offer to reship the product initially ordered or an exchange product with equivalent characteristics.  

Otherwise, a voucher will be credited to the buyer's account within 48 hours of receipt of the package.  

It will correspond to the amount of the total order (product(s) + shipping costs if your order is made up of only one product. If the order comprises several items, the shipping costs will remain due).  

If the buyer has chosen to be reimbursed, a transfer of the total amount of the order will be made to the account number that he will have sent to Legitech and within 15 days following the acceptance of the buyer's return (product(s) + shipping costs if the order consists of only one product. If the order is composed of several items, the shipping costs will remain due).

Art. 13.         Law - Disputes

These general conditions are subject to Luxembourg law. In the event of a dispute, the Luxembourg courts shall have sole jurisdiction.
